These Terms and Conditions (“Terms”) govern your participation in the Datagram Alpha Testnet (“Alpha Testnet”), operated by Datagram Group Ltd., a company incorporated in the British Virgin Islands (“Datagram”, “we”, “us”, or “our”). The Alpha Testnet is an early-phase deployment of the Datagram network intended for testing decentralized real-time communication infrastructure and node performance.
By operating a Datagram node, accessing the Alpha Testnet environment, or submitting performance data, you agree to be bound by these Terms. If you do not agree, do not participate.
The Alpha Testnet provides a live testing environment for Datagram’s decentralized infrastructure layer, supporting real-time applications such as video, voice, and low-latency data streaming. Participants may deploy and operate nodes to support compute, bandwidth, and availability tracking during this test phase.
Participants who meet certain uptime and performance thresholds may become eligible to receive future rewards through an airdrop. No rewards are guaranteed.
You may participate in the Alpha Testnet only if you meet all of the following requirements:
Datagram may conduct KYC/AML checks prior to any reward distribution and reserves the right to withhold rewards from ineligible or unverifiable participants.
Participants are responsible for the proper installation, configuration, and maintenance of their Datagram nodes during the Alpha Testnet. Specific instructions and requirements will be published through Datagram’s official documentation channels.By operating a node, you agree to:
Datagram reserves the right to disqualify or remove any participant from the Alpha Testnet at its sole discretion for non-compliance, misconduct, or malicious behavior.
Participants in the Alpha Testnet may become eligible for a future airdrop or other forms of recognition based on meaningful contributions to network performance, uptime, and reliability.
Eligibility will be determined solely by Datagram Group Ltd. and may be subject to additional requirements, including identity verification, compliance reviews, and technical validation.
Participation in the Alpha Testnet does not guarantee any airdrop or reward. Datagram reserves the right to modify, withhold, or cancel any such rewards at any time, for any reason, without prior notice.
Any future airdrop claim process, if made available, will be governed by separate terms and conditions.
During the Alpha Testnet phase, each user account is permitted to operate a maximum of one (1) node instance. Operating multiple node instances under a single user account (“Mult-Noding”) is strictly prohibited and may compromise the integrity of the Alpha Testnet.
By participating in the Alpha Testnet, you acknowledge and agree that:
These restrictions are in place to ensure fairness and data integrity during early-stage testing. Future phases of the network may adopt different participation rules.
The Alpha Testnet, including all related software, documentation, dashboards, APIs, and related infrastructure, is provided "as is" and "as available" with no warranties of any kind. Datagram disclaims all express, implied, and statutory warranties, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or uninterrupted performance.
To the maximum extent permitted by applicable law, Datagram Group Ltd. shall not be liable under any theory of liability, whether in contract, tort (including negligence), strict liability, or otherwise, for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your participation in the Alpha Testnet or use of any Datagram software, including but not limited to loss of data, tokens, profits, opportunities, or reputation, even if advised of the possibility of such damages.
You acknowledge that you are participating voluntarily at your own risk, and Datagram shall have no obligation to compensate or reimburse you for any reason whatsoever, including time spent, expenses incurred, system failures, or denial of airdrop rewards.
In jurisdictions where such disclaimers are not fully enforceable, liability shall be disclaimed to the fullest extent permitted by law.
You understand and acknowledge that the Alpha Testnet is an experimental environment that may be unstable or interrupted. By participating, you accept all risks associated with operating a node, including but not limited to software bugs, hardware failure, data loss, denial of access, incorrect reward attribution, or changes to program scope. Datagram is not responsible for any such risks, and you expressly waive any claims related thereto.
Datagram may terminate, suspend, or modify the Alpha Testnet at any time. Datagram also reserves the right to exclude any participant, with or without notice, for any reason including but not limited to:
You may cease node operations at any time, but doing so may affect your eligibility for future rewards.
All rights to the Datagram Node Software, dashboards, documentation, and branding are owned by Datagram Group Ltd.. These Terms do not grant you any ownership or commercial rights. You may use the software solely for participation in the Alpha Testnet.
You may not assign or transfer your rights or obligations under these Terms. Datagram Group Ltd. may assign or delegate these Terms, or any of its rights or obligations, to any third party without notice or consent.
You agree to indemnify, defend, and hold harmless Datagram Group Ltd. and its affiliates, officers, employees, agents, and contractors from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your participation in the Alpha Testnet; (b) your violation of these Terms; or (c) your violation of any applicable law or regulation. Datagram reserves the right to assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with us in asserting any available defenses.
These Terms are governed by and construed in accordance with the laws of the British Virgin Islands. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts of the British Virgin Islands.
Datagram reserves the right to update or modify these Terms at any time. Updated Terms will be posted via official Datagram communication channels. Continued participation in the Alpha Testnet after any modification constitutes acceptance of the revised Terms.
The following sections shall survive the termination of these Terms: Sections 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 17 and 18.17. SEVERABILITY
If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, such provision shall be deemed severed from these Terms, and the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
Datagram shall not be liable for any failure or delay in performance of its obligations under these Terms to the extent such failure or delay is caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, internet or telecommunications failures, power outages, civil unrest, war, labor disputes, government actions, or acts of terrorism.
